Users

Access to and/or use of this portal confers the status of USER, who accepts, from such access and/or use, the General Conditions of Use reflected here. The aforementioned Conditions shall apply regardless of the General Conditions of Contract that may, where appropriate, be of mandatory compliance.

Use of the portal

www.nitsdartalcastell.cat provides access to contents, information, services, programs or data (hereinafter, "the contents") on the Internet belonging to NITS D'ART AL CASTELL, or to third parties to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration that may be necessary to access certain services or contents. In this registration, the USER shall be responsible for providing truthful and lawful information.

The USER undertakes to make appropriate use of the contents and services that NITS D'ART AL CASTELL offers through its portal and, by way of example but not limitation, not to use them to:

• Disseminate content or propaganda of a racist, xenophobic, illegally pornographic, terrorism-glorifying nature or that infringes human rights.

Intellectual and Industrial Property

All distinctive signs, trademarks, trade names, contents, structure, design and form of presentation of the elements and any other information appearing on this website are the property of NITS D'ART AL CASTELL by itself or as an assignee and are protected by industrial and intellectual property rights.

The user is prohibited from reproducing, transforming, distributing, publicly communicating and, in general, any other form of exploitation of the elements referred to in the previous section without express authorisation from NITS D'ART AL CASTELL.

Exclusion of warranties and liability

NITS D'ART AL CASTELL is not responsible, under any circumstances, for damages of any kind that may be caused, by way of example: errors or omissions in the contents, unavailability of the portal or the transmission of viruses or malicious or harmful programs in the contents, despite having adopted all necessary technological measures to avoid it.

Modifications

NITS D'ART AL CASTELL reserves the right to make, without prior notice, any modifications it deems appropriate to its portal, being able to change, remove or add both the contents and services provided through it and the way they are presented or located on its portal.

Should the domain name contain links or hyperlinks to other Internet sites, NITS D'ART AL CASTELL shall exercise no control over such sites and content. NITS D'ART AL CASTELL shall in no case assume any liability for the content of any link belonging to an external website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, truthfulness, validity and constitutionality of any material or information contained in any of these hyperlinks or other Internet sites.

Right of exclusion

NITS D'ART AL CASTELL reserves the right to refuse or withdraw access to the portal and/or the services offered without prior notice, at its own request or that of a third party, to those users who fail to comply with the General Conditions of Use.

General provisions

NITS D'ART AL CASTELL will pursue non-compliance with the conditions as well as any improper use of its portal, exercising all civil and criminal actions that may correspond to it under the law.

Applicable law and jurisdiction

The relationship between NITS D'ART AL CASTELL and the USER shall be governed by current Spanish law and any dispute shall be submitted to the Spanish Courts and Tribunals.
